1. Introduction and Acceptance
Welcome to Ifindar.com (the "Site"), a job portal and services (the "Services") operated by [Ifindar /Ifindar.com] ("we", "us", "our"). We connect job seekers ("Applicants") with employers ("Recruiters") primarily in Uganda.
By accessing or using the Site, you, the User (Applicant or Recruiter), agree to be bound by these Terms and Conditions of Use ("Terms"). This agreement is legally binding. If you do not agree to these Terms, please do not use the Site or the Services.
2. Definitions and Eligibility
Key Definitions
- Applicant: An individual searching for jobs and submitting applications.
- Recruiter: An entity or individual posting vacancies and reviewing candidates.
- User: Any party using the Site, including Applicants and Recruiters.
- Content: All data, text, documents (CVs, job posts), and material uploaded to the Site.
Eligibility
The Services are only for Users who are at least 18 years of age and legally able to enter into contracts in Uganda. By using the Site, you confirm you meet this requirement.
3. Account Responsibilities and Conduct
- Accuracy: You are responsible for ensuring all information provided (CVs, job posts, contact details) is accurate, truthful, and complete.
- Security: You must keep your password confidential and notify us immediately of any unauthorized account use.
- Acceptable Use (Uganda Law Compliance): You agree not to post any Content that is false, deceptive, fraudulent, or that is discriminatory or illegal under the laws of Uganda, including based on protected characteristics like gender, religion, or ethnic origin.
- Prohibited Conduct: You must not engage in spamming, data mining, using the site for purposes other than recruitment, or attempting to compromise the Site's security.
4. Specific Terms for Applicants (Job Seekers)
- No Guarantee: We do not guarantee employment, job interviews, or the validity of every job posting. We are a platform only.
- No Fees Charged to Applicants: Ifindar.com will never charge an Applicant a fee to apply for a job. Immediately report any Recruiter or third party asking for payment to secure an interview or job.
- Data Sharing Consent: By applying for a job, you expressly consent to having your profile and CV data shared with the specific Recruiter for the sole purpose of evaluating your candidacy.
5. Specific Terms for Recruiters (Employers)
- Lawful Job Posts: You guarantee that all job postings comply with all applicable Ugandan laws, including labor, employment, and non-discrimination regulations.
- Authenticity: Job postings must represent genuine, currently open vacancies. Misleading or fraudulent posts are strictly prohibited and will result in account termination.
- Data Controller Obligations (Uganda DPPA, 2019): When you download or otherwise process the personal data (CVs, contact details) of Ugandan citizens, you become a Data Controller. You are legally required to:
- Process all data fairly, lawfully, and securely.
- Use the data only for the specified recruitment purpose.
- Implement adequate security measures to protect the data from breaches.
- Comply with the Applicant's data rights (access, correction, destruction).
6. Intellectual Property (IP)
All Content on the Site (excluding User Content), including the design, logos, and software, is owned by [Your Company Name/Ifindar.com] and protected by intellectual property laws.
By submitting Content (like a CV or job post), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and display that Content for the purpose of operating and promoting the Services.
7. Limitation of Liability and Disclaimer
- Platform Role: Ifindar.com is a passive conduit. We do not screen, verify, or endorse the validity of any Content (CVs or job posts). You use the Site at your own risk.
- No Warranty: The Site and Services are provided "as is," without any warranties, express or implied, including the implied warranty of fitness for a particular purpose.
- Limitation of Liability: To the maximum extent permitted by Ugandan law, we shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Site, including damages resulting from lost data, lost profits, or the conduct of any other User (Applicant or Recruiter).
8. Governing Law and Disputes
These Terms are governed by and interpreted in accordance with the laws of the Republic of Uganda. Any legal action or dispute related to these Terms or the Services shall be brought exclusively in the courts of Uganda.
9. Termination
We reserve the right to suspend or terminate your account and access to the Site immediately, without notice, if you breach these Terms or engage in conduct we deem harmful to the Site, other Users, or our business interests.
